CONDANNA DELLA TORTURA /
                              CONDEMNATION OF TORTURE

La tortura è peggiore della morte. Con la morte si finisce di soffrire, ma con la tortura non si finisce mai di soffrire perché pure dopo che sono cessate le sevizie, le vessazioni, eccetera, se ad esse si sopravvivere col il corpo si rimane per tutta la vita ancorati mentalmente in modo dolorosissimo al ricordo di quel che si è stati: dei torturati.

Le guerre non finiscono al momento del cessate il fuoco. Il dolore di chi ha subito le torture, le violenze: fisiche e psichiche, continua per tutta la vita. Mortificando l'anima. Ciò che si è patiti lede il senso dell'autostima, non si è più se stessi o se stesse. Rimane nella mente, ci si pensa ogni giorno, ogni notte. E sia le vittime che le loro famiglie soffrono di questo, possono a loro volta risentirne moltissimo psicologicamente. Una reazione a catena.

Gesù Cristo fu torturato, Spartaco fu torturato, molti partigiani e molte partigiane e tanti altri ed altre ancora furono torturati. Cosa è la tortura? La tortura è la più aberrante forma di maltrattamento che subiscono creature da parte di carnefici.
E da parte dei carnefici, si esprime la parte peggiore della mente umana.

Le umiliazioni nei confronti di coloro che avevano militato nella Resistenza continuarono pure dopo la guerra. Il potere dell'uomo sull'uomo continuava sotto mascherature diverse.

Le elezioni politiche che si tennero dopo la messa in vigore della Costituzione erano fortemente condizionate. Finanche il clero capitalista usava il suo potere condizionante nelle chiese tramite le prediche: associando Cristo a loro stessi e al partito più capitalista: la Democrazia Cristiana. E al fine del plagio che terrorizza: associando il demonio ai partiti della sinistra, sopratutto il Partito Comunista Italiano.

La paura del 'demonio comunista' e del fuoco eterno erano inculcati nei bambini piccoli nei tanti collegi e nelle tante scuole gestiti dal clero. In psicologia e psichiatria è risaputo che tali paure inflitte in giovane età non passano più, si porta la paura, del grottesco punitivo eterno in questo caso, tutta la vita. Ne erano colpiti particolarmente i bambini e le bambine che avevano o avevano avuto genitori che hanno fatto la Resistenza con i gruppi della sinistra. E quindi anche questo era un crimine, un delitto contro Dio, una specie di tortura psicologica inflitta a una generazione di bambini e bambine e le loro famiglie.

In Italia il fascismo è sopravvissuto, esiste ancora anche se sotto apparenze diverse. In pratica il fascismo si ripropone in nuove forme, ancora l'Italia continua a soffrire di quel tipo di mentalità retrograda e classista (il classismo è una forma di razzismo) da parte di chi comanda, detiene il potere. Da anni, anni ed anni non c'è giorno che non esca qualcosa di scandaloso, di vergognoso, di terribile, di doloroso, di umiliante per la gente comune da parte da chi comanda in politica e dietro la politica: corruzione, evasione fiscale, abuso del potere (e non finisce qui...): mali dentro e fuori le istituzioni ai danni dei cittadini comuni.

Il fascismo ( o comunque lo si preferisce chiamare) non è un fenomeno soltanto italiano. Ma perché in Italia succede e si ripete in modo così esteso questo abuso del potere?

E' una sorta di infezione comportamentale perché i prepotenti hanno bisogno di adepti per controllare eventuali dissidenti. Favorisce la corruzione tramite un mercato clandestino di favori grandi e piccoli. Favorisce anche l'esercizio del mobbing ed il bullismo nei posti di lavoro, nelle scuole, nelle case di cura e dovunque c'e il potere senza etica e le persone che non possono difendersi. Il predominio può essere fisico, psicologico o gerarchico mentre il danno subito ha sempre l'elementi di umiliazione, terrore e dolore fisico e psichico.

Sembrerebbe un paradosso, invece è una verità: un grottesco storico che viola il senso stesso della messa in pratica dei diritti umani.

Ci si accorge solo adesso che all'Italia mancava (manca ancora) una legge contro la tortura e chi la esercita? Ci sono voluti più di sessantanni per accorgersene? Strano il ritardo. Cioè che dall'inizio della Repubblica a tutt'oggi mancava all'Italia una legislazione a tal proposito, eppure è risaputo che i fascisti alleati dei nazisti praticavano abitualmente e brutalmente la tortura.

La denuncia è stata presentata da una persona che ha subito le violenze, considerate tortura, alla scuola Diaz, durante il summit G8 nel 2001. A seguito di ciò La Corte europea dei diritti umani, ha condannato l'Italia per la mancanza di una legislazione contro la tortura. ANSA provvede: l'informazione in lingua italiana

Il "paradosso" viene alla luce quando si capisce che a livello storico, il codice penale italiano è il codice Rocco di epoca fascista, a parte qualche rintocco. E' rimasto sostanzialmente lo stesso pure a discapito della Costituzione della Repubblica che è postuma a questo codice ma non può essere rispettata e applicata a beneficio del popolo intero, in quanto il codici sono ancora quelli dell'epoca umbertina e fascista. Così specialmente in politica chi trasgredisce la Costituzione non può essere adeguatamente punito in quanto "non esiste" la legislazione appropriata.

Fin quando l'Italia politica (... e quelli che stanno dietro i politici) mantiene le leggi e norme non democratiche per controllare l'etica della vita politica stessa non usciremo mai da questo angolo buio.

Noi il popolo cui la sovranità la Costituzione riferisce, vorremmo vedere finalmente attivata e rispettata la Costituzione. La Costituzione, che sancisce la sovranità al popolo, e il popolo siamo tutti e tutte non soltanto i VIP.

Popolo intero sovrano e rispettato, invece che oppresso dai suoi "rappresentanti" politici; vorremmo anche loro prendessero lo stipendio che percepisce la gente comune. Vorremmo anche costoro vivessero da poveri tra i poveri almeno sei mesi l'anno (rinnovabili). Così capirebbero sulla propria pelle e quelle delle loro famiglie il vero significato della povertà e il senso etico della democrazia.

Esigiamo il comportamento etico, il buon esempio, da parte della classe dirigente. Cosa che finora non è mai avvenuto. Non vogliamo essere più un popolo reso ostaggio del potere ed il suo abuso. La Resistenza e la Costituzione furono fatte per abbattere ciò, affinché l'Italia diventasse più civile.

Tempo passato, si dirà. Ma la storia è fatta da eventi che riferiscono tantissimo al "tempo passato". Non possiamo né vogliamo ripeterci.

Torture is worse than death. With death suffering ends, but with torture the suffering never stops; even though the abuse has ended, the mind remains painfully anchored, for life, to the memory of what happened: being tortured.

The signing of the ceasefire does not mark the end of a war. The suffering of those who have undergone torture and violence: physical and psychological, continues for life. Mortifying the spirit. The events endured damage self-esteem, change a person forever. The events remain in the mind, every day and every night. Both the victims and the families of the victims suffer for this, and the family members can in their turn be injured psychologically. A chain reaction.

Jesus Christ was tortured, Spartacus was tortured, many partisans (men and women) and many others have been tortured. What is torture? Torture is the worst possible type of ill-treatment that a persecutor can inflict on a victim. Those who inflict torture demonstrate the most devastating aspect of the human mind.

The humiliation of those who fought in the Resistance in Italy continued after the war. The persecution re-emerged under different masks.

The elections held after the Constitution came into force were strongly biased. Even capitalist clergy used their power in the churches, preaching sermons that associated Christ with themselves and with the most capitalist party: the Christian Democrats. They terrorized people by identifying the devil with the left-wing parties above all with the Italian Communist Party.

Fear of the "communist devil" and eternal hellfire were regularly drummed into children in the many children's homes and at the many schools run by the clergy. It is recognized in psychology and psychiatry that this type of fear, inflicted in young children, never fades. In this case, the fear of grotesque eternal punishment remains for life. The children whose parents had fought or died with the leftwing groups of the Resistance were especially damaged by these created fears. Therefore this was a crime, a crime against God, a type of psychological torture inflicted on a generation of children and their families.

Italy continues to suffer for this backward and classist mentality on the part of its powerbrokers. Classism is a form of racism: the poor are despised and wealth and power are pursued at any cost. Classism extends across all political groups. For years and years not a day passes without ordinary people being humiliated by the shameful discovery of a scandal involving political leaders and their entourages: corruption, tax evasion, abuse of power and more: evil, inside and outside the institutions, that damages ordinary citizens. In Italy the mentality of fascism survived the war, it still exists under different appearences. In practice, fascism is back.

Fascism is certainly not limited to Italy but why is this abuse of power so widespread here?

Infection spreads right through society because those at the top must cultivate ranks of compliant subordinates in order to control those who don't conform. Corruption thrives through a blackmarket of favours big and small. The blatant examples of power without ethics encourage mobbing and bullying in workplaces, in schools, in care homes: wherever there are people who cannot defend themselves. The domination can be physical, psychological or hierarchical. The damage to the victims always includes elements of humiliation, fear and physical or psychological suffering.

It may seem paradoxical but it is true, a grotesque historical fact that violates the practical establishment of human rights. It has just emerged that, under Italian law, torture is not a criminal offence? The legislation was (and still is) missing.

Has it taken more than sixty years to to notice this? A strange delay. From the beginning of the Republic until now, Italy has not had this criminal legislation, even though it is known that the fascist allies of the nazis regularly and brutally carried out torture.

The complaint was made by a person who suffered violence, considered torture, at the Diaz school during the G8 summit in Genoa in 2001. The European Court of Human Rights , has just issued a judgement against Italy citing Police violence: Italian criminal law inadequate and not an effective deterrent.(Download press release document

The "paradox" becomes clear when one understands the historical background: Italian criminal legislation dates from the fascist period (Rocco, 1930) with some modifications such as the abolishment of capital punishment. The legislation has remained in force at the expense of the Constitution of the Republic which was written after the war. The Constitution cannot be respected and applied to the benefit of the whole population. Often those who transgress the Constituition (in particular politicians ) cannot be adequately punished because the appropriate legislation does not exist.

While Italian political leaders (... and those who steer the politicians) maintain in force these inadequate laws and regulations to control the ethics of political activity, we will never get out of this dark corner.

We the people, to whose sovreignity the Constitution refers, want to see the Constitution activated and respected at last. The Constitution enshrines the sovreignity of the people, and we are all the people not just the VIPs.

All the people sovreign and respected instead of oppressed by their political "representatives"; we want them to get the same wage as ordinary people. We want them to get the same level of pension and benefits as ordinary people when they retire. We want to see them living with their families like poor people among the poor people for six months of each year. Then they would understand what poverty and ethical democracy really mean.

We demand ethical behaviour, a good example, from all those in society who occupy positions of power. We do not want to be held hostage by the abuse of power anymore. The Resistance and the Constitution were made to stop the abuse of power and to make Italy a more civil country.

Past times, one might say. But history is composed of events that very often relate back to earlier times. We cannot and do not want to repeat what has happened.
